    It is not clear what you mean when you say that. How can you get EAD without filing for 485 [which you can file only when your PD is current].


    We applied before the retrogression started

    2004 July - labor cleared for my husband

    2004 December applied for I140 and I485 --- I 410 approved EAD and AP issued

    I was in the country on F1 and applied for I485 along with my husband in 2004

    Graduated in 2005 and changed to H4 immediately although not required since the status is Adjuste status

    So when my PD becomes current they will let me know if we get GC or not

    My question was since i applied for I485 when i was on F1 will it be a problem. I asked my lawyer and he said no. But i dont know how far he is correct.

    You're not getting my point! If you the merchandise is defective it is perfectly fine to return it.

    Why do you guys feel the need to simply assume things and put words in someone's mouth and then go off trying to show off their opinions????

    Well, whether a merchandise can be returned after using, depands on the nature of the merchandise and the level of customer service provided by the seller.

    If you are buying a TV or a home theater, you don't know if it is functioning properly until you use it. And returning it within stipulated "return period" is not only legal but also ethical.

    Some high-end sellers will even guarantee customer satisfaction by allowing a return any time, yes any time if the customer is not fully satisfied with their product. There is nothing unethical about this. That is why these high-end stores charge you a premium in the first place.

    Not allowing return of merchandise reflects the low level of customer service we used to get back home. Obviously that level of service expectaion has been engrained in us so much that we believe returning used merchandise, even when the customer is not satisfied, is unethical.

    Have a questions for the Gurus...Is Credit Check performed during any of the processes related to FBI (for people who are present in the US with a SSN) ? IF so, will a Foreclosure in the credit check cause any problems or delays in adjudicating the 485 petition ?

    Airtel call quality is really good and it's cheap compare to reliance....I stopped using reliance almost 3 years......if you pay 9.99+taxes will give you 600 minutes talk time and 45 days validity...I also used for australia and singapore, call quality was great...never had any problems...

    01/26/2005: Good News for Visa Movement

    * AILA has reported the DOS advised AILA that "thanks? to" the decrease in demand for EB visa numbers from USCIS I-485 cases and 245(i) labor cases still being held in the Department of Labor, the visa number would progress forward as follows:

    o Worldwide EB-1 and EB-2: There will be no cut-off date for the these categories.
    o Worldwide EB-3: Unlike the DOS previous prediction that the large number of 245(i) filings would be filed during March and April 2001 and it would result in a surge of EB-3 number demand and would limit movement of the cut-off date, 245(i) cases still remain at the DOL and therefore there will be movement in EB-3 visa numbers.
    o India EB-1 and EB-2: It will continue a rapid movement for the next several months.
    o India EB-3: It will move ahead but may become limited down the road.
    o China EB-1 and EB-2: It will continue a rapid movement for the next several months.
    o China EB-3: It will stay at the Worldwide date.

    Like 140 premium that program will be first suspended and then dumped eventually because there are resource and Process problems internally.

    Unless you fix root causes - these Premium things ain't going to work.

    IV should propose a Premium Processing for FBI Namecheck/ Other Background checks. For certain extra fee UCIS/ FBI can do this on premium bases.

    People like you and boreal are doing much better because you decided that a 2 bed room house for rent is what you can afford because the prices shot up by guys like punjabi who wanted to make money and overbid on an house they cannot afford. Otherwise guys like you and many others would have bought house at a resonable price.
    Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.

    As I said I am against bailout. As none of these people/organizations should be bailed out. On this issues I resonate with you and boreal.
    But if I am in situation like Punjabi I will think in similar way. I think he has got enough suggestions for him. He needs to decide whether 20k is worth foreclosing.
    On living rich, I prefer living decent in long run than living rich for a few days and then suffering later ..

    If you can restart ur app in Eb2, you should be fine dates wise. Unless CIR messes it up.

    Approximately 2 months for PERM and then you can file 140+485 concurrently.

    Company A applied for my GC in Oct 2002. I received I140 and left the company on good terms and joined company B. company A promised that when my date becomes current they will authorize my 485. Now that my date is current, the company A is saying they cannot give me an employment letter because they are not doing well financially. The company has not more than 3-4 employees and they had been suffering losses for last few years. Now even if they have good intentions for me, they are unable to file for me.

    What options do I have now? restart GC process with company B and utilize my priority date?

    Please help. For a day I was excited about my date getting current but after al there was no reason for me to be happy.

    Use DD (due diligence).
    All you said is correct, except for you don't need Hepatitis B if you are over 16. No, there are no more tests involved, unless your tb is positive. If you tb is positive you need to do chestX-ray. I know that because I was just doing the tests for myself. Varicella must be taken twice 30 days apart. Same applies to MMR.

    I hope this helps. If you go to a good doctor, he will give you a complete list of things that you need to do before coming on the medical exam.

    It is economy. DOL vitually halted PERM approvals. Companies are not sponsering GCs as they used. If you give an Ad today, you will get 10 times resumes. So there is no easy way to get an approval.

    I think we are assuming that this will continue to be the case through Oct 2010. What if DOL changes policies with PERM approval tomorrow or the economy starts improving by March? EB2 ROW is current and there will be quite a few PERM's from them which will be adjusted immediately. We'll have to wait till the Sep results are in and the data is adjusted with 2005 EB2 numbers. Hopefully all < 2005 should be taken care of for EB2.

    I am expecting the Dates for EB2 Inidia and China will move to Dec 2006 in May with 12k Spill over.

    So if we get about 30k more for this whole fiscal year, assuming:

    From EB1: 10K more
    From EB4 and EB5: About 10K
    From EB2 ROW: About 10K


    Then EB2 I/C will move about 12 months ahead. That means the cutoff date would be around Jan2008 by Aug/Sep 2011. This is the best case scenario.


    If we get only 20k more for this whole fiscal year,

    Then EB2 I/C will move about 8 to 9 months ahead. That means the cutoff date would be around Jul 2007 by Aug/Sep 2011. This is the worst case scenario.



    This is just my estimation/guestimation.

    Whats also surprising is that number of pending EB1(India) applications is far less than expected. That would definately help EB2(India) in the spill-over (quarterly or yearly)
